Terms of Service
MILKSTOP IS NOT A MEDICAL DEVICE, CLINICAL DIAGNOSTIC SERVICE, EMERGENCY MEDICAL RESPONSE PLATFORM, OR SUBSTITUTE FOR PROFESSIONAL PAEDIATRIC OR MEDICAL ADVICE.
- Informational routine logging only: Milkstop is engineered strictly as a personal, self-serve routine-tracking utility for parents and guardians to record feeding times, milk volumes, nappy changes, and physical growth entries.
- No clinical guidance or diagnosis: All tallies, rolling 24-hour calculations, breastfeeding latch evaluations, and growth trend charts are reference aids only. They do not constitute clinical guidance or paediatric prescriptions.
- Do not delay emergency or medical care: You must never rely on Milkstop records or charts to make healthcare decisions. Never disregard, delay, or avoid seeking urgent care from a General Practitioner (GP), paediatrician, child health nurse, midwife, or hospital emergency department based on data in this application.
- In an emergency: If you are concerned about your child's hydration, breathing, lethargy, or health, immediately dial 000 in Australia, 911 in the USA, or 999/111 in the UK, or present directly to the nearest emergency healthcare facility.
1. Parties, Eligibility & Minors
These Terms of Service constitute a legally binding agreement between you ("User", "you", "your") and Milkstop ("Milkstop", "we", "us", "our").
Adult Eligibility Only: Access to and registration for the Service is strictly restricted to adult individuals aged eighteen (18) years or older who are the legal parents or court-appointed guardians of the infant being tracked.
Minors Strictly Prohibited: Minors under eighteen (18) years of age are strictly prohibited from creating accounts, signing into, or operating the Service.
2. Account Security, Manual Entries & Household Sharing
Authentication & Credentials: Authentication is handled via Google Identity Services OAuth 2.0 or passwordless email verification codes. You are solely responsible for maintaining device security and session confidentiality. Notify us immediately at hello@milkstop.app if you discover unauthorised access.
Accuracy of Manual Entries: Calculations, daily totals, rolling 24-hour summaries, and growth charts rely entirely on the accuracy and completeness of entries submitted by you or your invited household members. Milkstop accepts no liability for errors resulting from incorrect, delayed, duplicated, or omitted logs.
Household Sharing & Invite Codes: If you generate household invite codes to share an infant profile with partners or family members, you are responsible for managing those invitations. Invited members have full authority to view, log, and amend care events. You may reset or revoke invite codes at any time in Household Settings.
3. Acceptable Use & Platform Integrity
You agree not to:
- Scrape, crawl, spider, or extract data via automated bots, scripts, or unofficial interfaces;
- Reverse engineer, decompile, or disassemble the application or backend APIs (except as permitted under the Copyright Act 1968 (Cth));
- Bypass or attempt to defeat authentication safeguards, rate-limits, or security controls;
- Introduce malware, viruses, or any code designed to interrupt or compromise server infrastructure;
- Resell, lease, or commercially exploit the Service without our express written consent.
4. Intellectual Property & Care Data Ownership
Platform Property: The Milkstop web application, interfaces, design systems, algorithms, and branding are the proprietary property of Milkstop and protected by Australian and international intellectual property laws.
Your Care Data: You retain ownership of the raw data, feeding tallies, and notes you enter. You grant Milkstop a limited, non-exclusive license to host, store, back up, and process this information solely to deliver the Service to you and authorised household members in accordance with our Privacy Policy.
5. Availability, Offline Operation & "As-Is" Provision
The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
Offline Caching Notice: Offline entries are stored in your device's local browser storage (IndexedDB) until connection is re-established. Clearing browser cache, private window closure, or hardware resets prior to server sync may cause permanent loss of unsynchronised entries.
6. Limitation of Liability
To the maximum extent permitted by applicable law (including Schedule 2 of the Competition and Consumer Act 2010 (Cth), known as the Australian Consumer Law):
- Milkstop and its operators shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of data, profits, or clinical outcomes.
- Our total aggregate liability arising out of or related to these Terms or the Service shall be capped at the total amount paid by you to Milkstop for the Service in the preceding twelve (12) months, or $0.00 AUD if used on a complimentary/free-tier basis.
7. Account Deletion, Governing Law & Contact
Self-Service Erasure: You may delete your account at any time in Account Settings. In sole-member households, all infant profiles and care events are immediately and permanently purged from production databases. In shared households, your account is removed while infant routine logs remain accessible to surviving household members without your personal identity.
Governing Law: These Terms are governed by and construed in accordance with the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia.
